construction firm

Max Massie is a general partner in the construction firm of Massie, Briggs, and Yates. While operating a forklift at a construction site, Massie collides with a limousine owned by the mayor. The mayor sues not only Massie, but also Yates and Briggs. Yates and Briggs argue that Massie was at fault, so the mayor has no cause of action against them.

1.      What is a general partnership?

2.      Are Yates and Briggs correct in arguing that the mayor has no cause of legal action against them?

3.      If Massie was driving his own car on the way to the golf course when he collided with the mayor’s limousine, would the mayor have legal ground to sue the partnership? Explain.
