Jenny Beal is a dancer at Fourplayer in West Los Angeles. Beal recently got fired after she
complained to the LAPD that Fourplayer management was allowing dancers to have sex with
customers in private upstair booths at the club. After LAPD received Beal's complaint, it
conducted a sting operation and arrested several Fourplayer dancers for prostitution. Beal wants
to bring a lawsuit based on her termination, but has many questions she would like answered
before she commits to suing Fourplayer.
Â
Please, select the answer.
Â
23. Beal wants to know what would be a potential bar to a wrongful termination suit:
A. She signed an agreement stating she was an independent contractor and danced
elsewhere.
B. Labor Code §2922's at-will provision
C. Fourplayer is not a state actor.
D. The First Amendment doesn’t cover obscene speech.
E. She can mitigate her damages immediately by taking a dancing job as a Lakers Girl.
Â
Â
24. Beal wants to know if she was paid as a 1099 worker and not as a W2 employee if this means
she cannot have a viable lawsuit against Fourplayer- which best describes her situation:
A. She would not have a viable lawsuit as she would be an independent contractor.
B. This fact alone wouldn't bar a wrongful termination lawsuit.
C. She would have a viable lawsuit even if she were an independent contractor as
prostitution is a crime of moral turpitude.
D. She wouldn't have a viable lawsuit as she assumed the risk of being fired when she
complained about the oldest profession known to man.
E. She might as well sue as she is an ordinary dancer with nothing to lose- not even her
G-string.
Â
Â
25. Beal wants to know if she is able to bring a viable employment lawsuit based on wrongful
termination then what damages could she get:
A. Loss of Earnings
B. Emotional Distress
C. Loss of Consortium
D. A and B
E. Seats in John Wooden's row at the new home for Pauley Pavilion
Â
Â
26. Beal wishes she had taken CS 172 and is very interested in understanding more about what
independent contractor status means. What will you tell her is helpful in showing she wasn't an
independent contractor:
A. She worked hours set by Fourplayer.
B. She danced to the music set by Fourplayers deejay even though she wanted to have
Drake play.
C. She was given a uniform to wear before she stripped at Fourplayer.
D. All of the above
E. She sat with all the dancers and in unison rooted for the mighty Bruins to repeat as
college softball champions.
Â
Â
27. Beal believes she was sexually harassed by Fourplayer’s general manager Nicholas Hurley.
Beal wants to know if a harassment claim would be barred if she was an independent contractor.
A. Yes, under federal law
B. Yes, under state law
C. A and B
D. None of the above
E. Beal should be worried about bars if she hopes to enroll in Pittsburgh’s Conservatory
of Dance and be a high jumper on the track team.
