Write a paper between 10 and 15 pages in length

Write a paper between 10 and 15 pages in length; the topic is Obergfell v. Hodges, it will also need to be focused around the supreme court decision in that case and also how the fourth amendment was applied by the court, it should also make connections to previous cases surrounding the 4th amendment as well as gay marriage, one case specifically that needs to be included is Brown v. Board of education.

- of sufficient analytical depth

- are supported by high quality resources such as statutes, case law and law review articles;

and the paper should be focused on the Obergefell case. Of course, you will use Loving and Brown to discuss Obergefell. However, your paper should focus on whether you believe that the majority reached the correct decision or the possible legal effects of this case?  you want to clearly set forth your thesis, i.e., your position on the case in your introduction, then describe the case's background (this is where you discuss Loving and Brown and other cases dealing with same sex marriage) and then you discuss what the court did in Obergefell. In your reasoning section, you need to discuss your explanation for what you agree or disagree with the majority's position and/or your interpretation on the legal effects of the case. discuss why the dissenters were wrong. Finally, you need to wrap up everything in your conclusion. Present a coherent argument throughout the paper

An outline of how the paper should flow is like this.

  1. Introduction
    1. Introduce and note why the topic is important
    2. Briefly summarize necessary background information
    3. State your thesis
    4. Convey your organization of the paper
  2. Background
    1. Describe the genesis of the subject
    2. Describe the changes that have occurred during its development
    3. Explain the reasons for the changes
    4. Describe where things are now. (You may also indicate the reasons for further change.)
  3. Statement of the Case
    1. Include the relevant facts
    2. Include the procedural history if it is material to the court’s disposition of the case.
    3. Include the court’s holding and reasoning at each level, as well as the reasoning of dissenting or concurring opinions. Clearly distinguish their divergent approaches from the majority’s approach. Present the court’s opinion without extrinsic analysis or editorial comment, thus providing the reader with an objective explanation of the majority’s rationale. Set out the manner in which the court arrived at its decision and why the court did so, using only the reasons and policy considerations that appear in the opinion.
  4. Analysis- the centerpiece of the paper
    1. Highlight your creative and intellectual abilities as you analyze the topic or case.
    2. First explain the relevant case law, thus demonstrating how the law reached its present state.
    3. Make it the longest section of the paper, generally requiring several strands of analysis.

Large-Scale Organization

  1. Discuss the major issues
  2. Separate the issues
  3. Order issues logically

                        Small-Scale Organization

  1. Introduce and conclude on each issue
  2. Separate issues and sub-issues
  3. Use organizational paradigms where appropriate
  4. Conclusion – The conclusion should briefly summarize the arguments presented and the conclusions drawn from those arguments.
    1. Restate thesis
    2. Summarize the major points
