Is the US Constitution an example of Natural Law, Positive Law or neither? And, what role, if any, do Natural Law ideas play in the US legal system?
Â
Some notes on natural and positive law:
Natural law is used to describe laws that are derived from moral reasoning and humanity. Natural laws are basically laws that advocate for the common good of the people. Natural laws are deemed universal and apply to all human beings.
Positive laws on the other hand describe laws that are derived from legislative means i.e. parliament and congress and applies to citizens of the country or subjects of the ruling authority. Positive laws are enforced by government agencies and authorities and must be written down in legal documents e.g. a constitution.
Natural laws are existent in the US legal system especially at the judiciary. A perfect example of the application of natural law is the case involving Conestoga Wood Specialties Corp. which wants to be exempted from Obama care as their owners believe that contraception is evil and against God’s wishes.
