This is for Law Class.

In the city of NYC, is it illegal for an employer to pay an employee for more hours than they actually worked? E.G Bob worked 45 hours but Company X has paid Bob for 50 hours. Is that illegal? 
 Also what happens if an employee does not punch in and out of time card.  Please show reference or sources. Will include 40 dollars gratitude after question is answered with source.
