You work for a law firm that is represent XYZ Landlord.   This landlord wants to evict Kim Smith as her children run around the apartment complex all hours of the night making very loud noises for which they have received numerous complaints from other tenants.  Kim Smith is paying her rent on time and is a month to month tenant. There is a Maryland law (Real Property Code Sec. 8-402) which states that if a tenant is going to be evicted for any reason other than paying rent, the landlord must provide the tenant 30 days written notice to vacate.  The law does not state that the reason for vacating must be provided to the tenant.  The landlord did provide a notice to vacate to Ms. Smith but did not state why they wanted her to vacate.  The landlord wants to know if they have given a proper notice to vacate to the tenant.
