Give your opinion of the Kuhlmeier (Hazelwood School District v. Kuhlmeier) case. And also discuss Kincaid v. Gibson. At what age do young people have First Amendment rights under the law? Does a school principal have the legal right to censor a high school newspaper that writes an editorial critical of him/her? How are college newspapers any different? Using Kuhlmeier as your guide, explain how you would rule in the following case: A Jacksonville high school principal told his journalism students recently that they could not publish a story, called "Breaking the Rules - Punishment Depends on Who You Are." The story detailed a number of instances where white students were punished much more severely for violating various school rules, ranging from parking in reserved spaces to smoking tobacco on campus. The article identified students by name. The main theme of the carefully investigated piece is that nonwhite students were rarely punished for rule infractions on campus. White students always received stiff punishment, including suspension from school. Every charge in the story was carefully documented and absolutely and provably true, with supporting school records. The school paper, Breathing Space, is published as part of the journalism class. It has won many state awards and is read by nearly all students and members of the local board of education. You are the judge and must rule on whether the principal has the legal right to take this story out. Explain your ruling. Cite precedent. Explain your reasoning.
