Do people have a legal right to privacy? Why?

1) Do people have a legal right to privacy? Why? Based on what? Is privacy mentioned in the Constitution? Was it important to our founding fathers? If not, how can we claim such a right today?

2) Discuss the concept of malice. Why is this an important issue in libel cases? Can you identify malice when you see it? Do you agree with the way the courts have defined it? How would you change that definition? Cite precedent.
