There is a minor fire at 2 a.m. in a men's-only dorm on campus. All residents are evacuated. A Spinnaker photographer is among them. He takes several pictures, including one that shows a young woman rushing outside, wearing only a raincoat. This picture runs in the Spinnaker. Her private parts are covered by the coat, but it is clear from her exposed legs she is nude underneath. The young woman sues for invasion of privacy. She says she was sleeping on a male cousin’s couch (in the nude), after drinking too much at a party in the dorm. She says she did not want to drive home drunk. You are the newspaper's lawyer. Explain how you would defend the paper. Then defend the woman in her suit. Now be the judge and explain how you would rule and most importantly, explain why. Cite precedent.
