1. Describe nonjudicial punishment as used in the military. Address, at a minimum, when is it appropriate to use, the three types and how a commander determines the appropriate level, and the punishments available should the service member be found guilty. Finally, provide two examples --- one when a commander would appropriately use nonjudicial punishment, and one where nonjudicial punishment would not be appropriate. An active duty service member posts the following on his Facebook page: “Screw Obama and I will not follow all orders from him.” He also wrote, in an apparent play on his oath to protect the U.S. Constitution from “enemies foreign and domestic,” that “Obama is the economic enemy … He is the religious enemy … he is the ‘Fundamentally change’ America enemy … he IS the Domestic Enemy.” Is this protected speech, or can the service member be punished?
