Torts Assignment 2
Class, we have discussed respondeat superior and vicarious liability.  Please pick a case (one that is not in the text) that concerns this issue. Make sure the case deals primarily with a vicarious liability and not just indirectly, i.e., a jurisdictional question. Read the case carefully and prepare a brief of the case. A brief should contain a good summary of the facts (not a copy and paste, but your words) and the issue or issues involved in the case pertaining to the intentional tort. If the case you pick also has jurisdictional questions, etc. do not include those issues; however, issues regarding whether or not to grant summary judgment. On the issue may be relevant. After the facts and issue, discuss the court’s analysis of the pertinent law and reasoning involved in their conclusion; afterwards, state the conclusion or holding of the court. Finally, state whether or not you agree with the holding and why. The format may be as follows:
Facts:Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â 10 points
Issue:Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â 20 points
Analysis:Â Â Â Â Â Â Â Â Â Â Â Â Â Â 50 points
Conclusion:Â Â Â Â Â Â Â Â Â 10 points
Your opinion:Â Â Â Â Â Â 10 points
Â
Include a copy of the case with your brief. Your grade will be based on how well you understand the case and the reasoning for the holding (whether or not you agree with the holding).
