The Supreme Court alone has the power to interpret the United States Constitution. In doing so, the members of the court basically fall into two distinctive theories about how the constitution should be interpreted. The “living document” school believe that the constitution should be interpreted in a non-literal sense and that any decisions concerning the constitution give due consideration to the modern, present state of society and technology.

 

The “strict interpretation” theory believes that the constitution should only be interpreted according to the literal language of the document and that no modern interpretation be allowed to affect or modify the strict intentions of the founders. At present, the court is roughly evenly divided between the two schools.
