In Chapter 7, we take an overview of employment law and its evolution since the passing of the Civil Rights Act of 1964. In our study, we focus on employment law within the framework of the three bases for discrimination: disparate treatment/impact, retaliation and harassment. The common thread for employment law since 1964 has been the prevention and/or elimination of discrimination in the workplace based  on these three bases.

  1. In the Lockheed Martin case, we encounter a scenario of blatant and direct harassment based on race. How might Lockheed Martin have ensured that this type of behavior was prevented? How should the corporate HR department have responded to the complainant?
  2. For sexual harassment to flourish in the workplace, what underlying values must be present in the workforce?
  3. Review the EEOC Complaint process and discuss the areas you feel are most likely to delay adjudication of a claim.
