Case Study I

 

“I’m sorry, Danielle,” said Jetta Goh, the owner and manager of the Golden Dragon restaurant.  Ms. Goh had placed a classified ad for a server in the employment section of the local newspaper.  The response was good, and Danielle Hidalgo the daughter of a Mexican citizen and an American who was born and raised in the United States, had applied, as well as many others.  Danielle was an excellent server with an outstanding work history.  She was learning, via the telephone, however, that another candidate of the same ethnic background as Ms. Goh had been selected for the job. 

 

Ms. Goh continued, “You know, Danielle, people come to the Golden Dragon for an Asian dining experience; they expect Asian servers.  That’s why I only hire a certain type person for front of the house positions, but there could be a spot for you in the back of the house.  Are you interested?”

 

The above case analyzes the issues faced by HR managers who seek to balance the legitimate needs of their business with the legal realities they may face.  You may have an opinion about whether what Ms. Goh said is right or wrong, but what is the legal reality? 

 

1.     What are the legal issues presented in the above case?

2.     How do these laws apply?

3.     Research the Hooters cases (gender, weight and racial discrimination claims) and their requirements for servers. Is the Hooters case similar to the case study above or how is it different?

 

 

In addition to the above situation, consider similar issues of whether or not a company can legally tell an employee that because of a particular position they would occupy in the organization, they could or could not have tattoos, body piercings, or dress a certain way because of religious beliefs.
