The personnel director at East High School thinks she is in big trouble. Ten years ago, 30% of the residents in the county were Hispanic yet only 5% of the school employees were Hispanic. To remedy this situation, the school system developed an affirmative action program in which at least 40% of all new hires were to be Hispanic. The program had been working well because today 25% of all school employees are Hispanic compared to 28% in the qualified work force.
 Last week, however, a white employee who wasn't hired for a teaching job filed a lawsuit challenging the legality of the affirmative action plan. Tory Bolton claimed that he was more qualified than the minority applicant who received the job. Bolton had a 3.4 college GPA and three years of teaching experience whereas George Lopez, the minority applicant, had only a 3.2 GPA and two years of teaching experience. Should the personnel director be worried? Why or why not? Use the flowchart attached, Be sure to discuss your decision at each step of the flowchart.

 This case sure does make you think. I first thought that no; there really shouldn't be an issue. They have similar histories in experience and GPA's. Maybe George interviewed better than Tory. You know that does happen quite often. After further review though, this case may cause a problem for the personnel director. According to the flow chart in figure 3.4, "Determining the Legality of an Affirmative Action Plan" (Aamodt, M. G. 2015 pp105), I concluded the following:
1. Was there history of discrimination - No
There was no discrimination as only data pertaining to percentage of Hispanic population in the city vis-a-vis school employees was analyzed. The data was used to correct the imbalance subsequently.
2. Does the plan benefit only people who were actual victims of discrimination? - Yes
The plan only involved to ensure at least 40 % of new recruits to be from Hispanic community.
3. What population was used to establish goals? - Area population
The general population of the county was only considered to establish plan and no data on qualified workforce was collected.
4. Did Affirmative action method trammel rights to non-minority? - Yes
The Affirmative action is to ensure equal rights of employment to all and without discrimination. In this case Tony Bolton was discriminated owing to the school's policy of ensuring 40 % new recruits to be from the Hispanic community.
5. Is there an ending to the plan? - No
There is no time limit for the plan and is open. It therefore does not adhere to Affirmative action where the provision is to ensure equal employment opportunities for all but does not have a provision to reserve certain percentages for minorities.
