Fred was an employee of the Plumbing R Us Association. He was fired. Fred thought he fired because he was a member of a labor union. Plumbing R Us asserted that he was fired because he had poor attendance and his work was sub-standard. Fred filed an unfair labor practice complaint with the National Labor Relations Board. Its examiner held a hearing at which evidence was presented showing that Fred was a poor worker and he had poor attendance. Other evidence presented showed that the employer was opposed to labor unions. The Board decided to believe Fred's witnesses and concluded that he had been fired because he belonged to the union. Using IRAC, determine whether the employer would win the appeal? (MUST BE ANSWERED IN IRAC)
