Haru, who is partially lame, is the most qualified candidate for a job opening at SuperPrestigiousAccountingManagers [aka “SPAM”] based in Seattle. Haru is a middle-aged Japanese man, lives with his domestic partner Omuya, and has both U.S. and American citizenship. Haru had met Omuya while both were in the U.S. military in Iraq. SPAM wants to uphold its super prestigious reputation and image. SPAM is determined to keep its perfect image, because it works closely with government (federal, state, and local) and its most important clients are from all over Western Europe. SPAM wants all of its clients to feel comfortable working with all of SPAM’s employees. Haru is fluent in English, as well as Japanese, and all of SPAM’s clients speak English. SPAM decides not to interview Haru. Instead, SPAM grants interviews to Elizabeth, Emily, and Olivia, all of whom are between the ages of 20 and 24, were born in Seattle, were accomplished high school athletes but have much lower qualifications than Haru. Elizabeth, Emily, and Olivia look just like everyone else who has ever worked at SPAM. Haru explained its decision not to interview Haru by saying, “We are not selling ramen here.” If Haru decides that he wants to consider legal action against SPAM, what are his options? Imagine that you are Haru’s attorney and are going to explain all of his options to him.
