Acme Foods, in Boise, Idaho, orders 100 cases of Grade A canned peas, âFair Dealâ brand, from Pride Produce in Walla Walla, Washington, to be shipped F.O.B. Walla Walla. Pride sets aside 100 cases of Grade A canned peas, âHealthful Bountyâ brand, and contacts Federated Freightways on Monday to pick them up for shipment. Federated Freightways informs Pride that the peas will be picked up on Wednesday morning. On Tuesday evening, Pride suffers a fire after closing, and the peas are destroyed. Acme sues Pride; Pride says that the fire is not its fault, and the risk of loss had passed to Acme. Who is correct, and why?
