"depressed and suicidal young female nurse

A 33 year old male posed as a "depressed and suicidal young female nurse" on a suicide websites. Responding to posts on these websites, the fake "nurse" covered with suicidal individuals pretending to care and understanding to win trust. He encouraged them to "hang themselves" and falsely claim that she would also commit suicide. Five people entered into the suicide pact, two of them committed suicide. Law enforcement were able to connect his internet aliases to his email address. He admitted that he posed as a suicidal nurse and did the messages. He was prosecuted under a law that "makes it illegal to intentionally advise, encourage and assist another in taking the other's own life". The court convicted him on these charges. The court concluded that his speech fell outside the protections of the 1st amendment. He appealed that the State law violates the 1st amendment. 

Review the constitutionality of the law. Does the law violate the 1st amendment? Can they prosecute him for assisting advising or encouraging another to commit suicide?
