Suppose you were a guest at a wedding reception. You became very ill due to eating spoiled food which the venue served. It required you to go the hospital and miss work. At the end of the experience, you paid $3,000 out of pocket. In the state where you consumed the food, there is a state supreme court landmark case pending concerning privity of contract. Your lawyer advises you that it might be unwise to begin a lawsuit for breach of contract while this lawsuit is pending. It could go 50/50. You can't wait for the supreme court to make a decision since your bills are arriving in the mail.
