This week we are discussing the authority of the agent.  What happens when an agent (employee) exceeds his authority and someone gets hurt?  Who will be liable for the injuries?  Well that depends.  Employees who work in the field receive a company car with instructions that they are to use the car for employment purposes only.  It is a common practice that all field employees meet for happy hour at the end of each day.  Everyone knows about this conduct and the supervisors and managers have never disciplined anyone for this conduct.  After leaving happy hour, Harry has a really bad car accident in the company car and a person ends up dying.  Both Harry and the employer is being sued.  Who should prevail and why?
