Scenario 2:

Tucker Cartwrite was playing blackjack at the Gold Dust Casino in Deadwood SD. He became angry that he was losing money and decided to break a chair at the blackjack table. He was banned from the premises by the owner of the Gold Dust and advised he could never return. Despite the ban, Cartwrite returned to the Gold Dust 2 months

later, walked past the security guard and started gambling at a slot machine. He won $4,532. When he went to the cage to collect the winnings, the casino refused to pay. He filed suit for breach of contract, arguing that he and the casino had a contract because he had accepted its offer to gamble.
