1.Pippa Livingston is an opera singer whose performances are often sold out worldwide. Pippa entered into a written and signed contract with the Madison Opera House to perform on January 15th and 16th. Madison paid $100,000 to advertise Pippa’s performances in print and online and had advance ticket sales for more than half of the seats at each performance.

(a)On January 13th, Pippa was hit by a police van that ran through a red light and broke her left arm and left leg. Pippa is unable to perform at Madison Opera House on January 15th and 16th. Is Pippa liable to Madison for breach of contract? Explain.

(b)Instead of the facts (a), Pippa does not perform at Madison Opera House because she received a better offer to perform at the Berlin Opera House on January 15th and 16th. Is Pippa liable to Madison for breach of contract? Explain.
