Todd Jones, telephoned the manager of an emu farm because he wanted to buy a male and female emu for breeding. After receiving assurances from the manager that he was buying a male and a female, Todd paid $20,000 for the emus. When breeding season arrived, Todd waited patiently but nothing happened between the emus. Todd called a veterinarian who discovered that the manager sold Todd two male emus. Todd was out $20,000 plus the lost profit he would have made from breeding the emus.
