I need a 100 word post reply in the role of a questioner. The questioner's role in the discussion is to "question" how the week's discussion question relates to other academic concepts, current events, or workplace tasks/processes. This is the initial post:
"According to this weeks reading, the dormant commerce clause comes into play when state regulations affect interstate commerce. In this situation, the courts normally weigh the state's interest in regulating a certain matter against the burden that the state's regulation places on interstate commerce. (Miller 12). Every state look at the Dormant clause a little different when dealing with purchasing prescription drugs online. I personally do not think this should be aloud because any one can get it. It is not as safe as you seeing the doctor and taking a written prescription to the pharmacy yourself. I live in the state of Alabama. No nonresident pharmacy shall ship, mail or deliver prescription drugs and/or devices to a patient in this state unless registered by the Alabama State Board of Pharmacy. In Alabama it is considered inappropriate to prescribe medication over the Internet without performing an appropriate history and physical examination, make a diagnosis, and formulate a therapeutic plan, a part of which might be a prescription. And when this process is done it should be documented appropriately. It is the position of the Board that prescribing drugs to individuals the physician has never met based solely on answers to a set of questions, as is common in Internet or toll-free telephone prescribing, is inappropriate and unprofessional.( Ala. Admin. Code r. 540-X-9.11. Contact with Patients before Prescribing.) I agree with my state regulation when it comes down to prescription drugs and the Internet. I do not think it is violating the dormant commerce clause. It seem to be doing more good then harm. Prescribing drugs via the Internet can be very dangerous especially if you have not seen the patient in person because you may be prescribing something that may have a worse affect in the long run. I believe every doctor should see the patient before prescribing medicine online. In Alabama we do have doctor offices that prescribe medicine to a patient through the Internet but the prescription goes straight to the pharmacy system."
