 Paul owns a tour boat cruise.  Dan was hurt and is suing Paul for negligence arising out of a boating accident. Discuss what Dan needs to show for negligence – discuss each element below.  (7 points)

 

1.  To establish liability under a negligence theory, the plaintiff must show (1) that the defendant owed a duty to the plaintiff to act in conformity with a certain standard of conduct, that is to act reasonably under the circumstances; (2) that the defendant breached that duty by failing to conform to the standard; (3) that a reasonably close causal connection exists between the plaintiff’s injury and the defendant’s breach; and (4) that the plaintiff suffered an actual loss or injury.   

 

2. Provide your own original idea of at least 2 policies on how businesses can prevent the risks of torts above, describing what employees and management should do to prevent such risks.  (3 points)
