This exercise has the following purposes:

  1. Apply your knowledge of criminal law to business settings.

Directions

This assignment consists of three questions. For each question write 2-3 sentences stating what crime (if any) did Tom commit, andexplain why. (focus on knowing the importance of BOTH the criminal act and the criminal mind.

  1. Tom is standing in line to board a train.  Someone pushes Tom from behind.  Tom’s momentum results in Tom bumping another person who falls into the path of an oncoming train.
  2. Tom enters a (legally operating) fireworks store, intending to steal fireworks.  The store is dark.  Because it is dark Tom strikes a match for light; the match ignites the fireworks, and the store burns down.
  3. Tom rents a room above a gambling den. He drills holes in the floor boards with the plan to break into the gambling den to steal money from the gamblers. Before entering the gambling den, Tom decides to not continue with the theft and leaves. However, Tom accidentally left in the rented room, his tools and written plans to rob the gambling den. The police find Tom’s tools and written plans and arrest Tom.
