Lydia Hagberg was a customer of California Federal Bank.

Lydia Hagberg was a customer of California Federal Bank. she want to the bank to cash a check payable to her and issued by Smith Barney. The bank teller believed the check was counterfiet. She telephoned Smith Barney and was informed by a Smith Barney employee the check was invalid. The teller then telephoned the police.

Another bank employee, a security guard, telephoned Smith Barney a second time and learned the prior statement was incorrect and the check was valid. But the police had arrived, ordered Lydia to spread her arms and legs for a pat-down, and handcuffed her. Her purse was searched, she was asked questiones about possession of weapons and whether she was driving a stolen car, and then arrested. So Lydia filed a lawsuit for slander against the bank.
