  • Meanwhile, Terry got the another good offer, where Dave can sue Terry to complete his assignment first before accepting any other work, as he is bound to perform the work which was contracted between two of them.
  • As Dave in worried situation, offered over and above the contracted amount to complete his work, but no correction was made in the original contract. In such case, it is mere an mutual agreement between two of them, no contractual terms were amended in original contract, Terry can claim for only $4500, nothing more than that from Dave.
