EXTRA CREDIT ASSIGNMENT! :-)
Use the legal researching skills to find a recent case on the internet involving a tort where a businessis involved as one of the parties. You can use a recent court case, or you can use an article describing a case making its way through the courts right now. Find a case that interests you, and briefly answer the following questions:
What is the name of the case?Â
For Example;Â iffany (NJ) Inc. v. eBay Inc., 08-3947
What tort is involved in the case?
Many: Trademark dilution, trademark infringement, false advertising
What happened that gave rise to the case?
Â
For Example: eBay was allowing sellers to sell fake Tiffany jewelry.
Based on your learning in this lesson, who should win and why?
For Example... Â It depends. If eBay took precautions against the sale of counterfeits, they should win. Otherwise, Tiffany should win, because eBay damaged their sales by allowing people to falsely represent the items they were selling.
If the court already determined a winner, did the court get the decision right? Why?
Â
For Example: To my understanding, the court decided that eBay had taken adequate precautions against counterfeit sales.
