1. Â You have likely noticed that many products are similar. Â For instance, there is a "generic" of almost everything. Â How dissimilar does something have to be in order not to violate any laws such as trademark, copyright, etc?
2. Â Is there a difference between a contract and an enforceable contract? Â What is required in order to have an enforceable contract? Â Does it have to be written?
3. Â What is rescission of a contract? Â When can/should it apply? Â What is specific performance in contract situation? Â When can/should it be applied? Â Of these two remedies, which is most likely to be used?
4. Â Define personal property. Â What is the difference between mislaid and lost personal property, if any? Â If you find personal property, does your responsibility change depending on whether it is mislaid or lost? Â
5. Â Define real property. Â What are the different types of concurrent ownership of real property one can have? Â Which type of concurrent ownership is best?
6. Â In the U.S. our laws protect ideas, giving individuals the right to "own" the idea and profit from it. Â Other societies, however, believe that ideas are for the benefit of society and can not be "owned" by the individual. Â This sometimes cause problems when it comes to expansion. Â If something is made in the U.S., but the company wants to expand it to a country that has a different view of "ownership", does that create a problem? Â Why or why not?
