Ledbetter v. Goodyear Tire & Rubber Co.

The issue that I want to address from the case is the reasons why Ledbetter lost her pay discrimination case in the Supreme Court. According to the Equal Employment Opportunity Commission (EEOC) employees should file a complaint within 180 days of their first discriminatory paycheck unless they discover about the discrimination later. The controversy occurs because Ledbetter had known about the discrimination for five years and only filed the case later, after the 180 day period had elapsed (Bader, 2013). The characteristic of the economic system that serves as the settings, in this case, is a two class system; the capitalist class who own the means of producing and distributing good and the working class who see their labor to the capital class in exchange for wagers. The main aim is profit maximization (Friedman, 1970). The laws that are likely to affect the operation of the business include labor laws that guide employer-employee relationships, regulatory laws, tax laws and reporting laws.

The case takes place in the US. The laws related to gender discrimination issues in the US include EEOC which prohibit discrimination based on an individual's race, age, national origin, sex, religion, gender identity, disability, genetic information, among others. The Equal Pay Act (EPA0 of 1963 which prohibits employers from paying different wages based on sex and the Civil Rights Act of 1964 which prohibits employer discrimination based on the employment relationship. Goodyear Tire & Rubber Company has been violating all the above laws. The laws that unfairly limit the goods and services that can be offered to and are demanded by consumers include consumer protection law and Fair Trading Act (Brake, 2000).

Women should receive equal treatment in the workplace in terms of wages with their male counterpart. The ethical theory that I chose to apply is deontology theory. The theory advocates that the morality of an action should be based on rules, we are morally required to act in accordance with a certain set of principles. The main characteristic of the theory is the obligation to do the right thing (Richards, 2002). In this case, they already set the principle that Goodyear Tire & Rubber Company should have acted in accordance with. For instance, the Equal Pay Act of 1963 prohibits employers from paying different wages based on sex. Ledbetter received a lower pay compared to her male counterparts for all the years she worked for the company. In addition, EEOC clearly points out that it's illegal and unethical for Goodyear Tire & Rubber Company to discriminate Ledbetter and pay her lower wages compared to the other males in the same position. Therefore women should receive equal treatment with men in the workplace (Bader, 2013).

Thomas, Great job on your discussion post this week. The 1963 Equal Pay Act prohibits sex-based discrimination. . Although Ms. Ledbetter ultimately lost her lawsuit due to the Supreme Court’s 5-4 ruling of her case based on the untimely filing of her claim, EEOC (2017) noted, “On January 29, 2009, President Obama signed the Lilly Ledbetter Fair Pay Act of 2009 ("Act"). This law overturned the Supreme Court's decision in Ledbetter v. Goodyear Tire & Rubber Co., which severely restricted the time period for filing complaints of employment discrimination concerning compensation” (p. 1). Specifically it amends the 180-day statute of limitations for filing on equal-pay lawsuits regarding pay discrimination.  Why do you think Ms. Ledbetter waited so long to file her lawsuit? Do you think she was in fear of losing her job or perhaps she was an underperformer and that is why she was not paid the same as her male counterparts?  I agree the Deontology theory applies focusing on what is morally right and the duties and obligations that Goodyear Tire & Rubber Co. have in car­rying out actions rather than on the consequences of those actions. I also believe the Supreme Court had an ethical obligation to act morally good in those ways that all rational beings would find acceptable. For example, Fieser (2015) noted, “By using the Golden Rule, do unto others as you would have them do unto you, it’s your duty to act acting morally right and morally good. (p. 14). If the Supreme Court would have acted using the Golden Rule, I believe Ms. Ledbetter would have won her lawsuit.
