two questions please answer both or at least one

  • In a criminal case, the prosecution has certain pretrial discovery rights.  In light of the government's power to charge a person with a crime which could lead to a loss of property, liberty or even life as a consequence, is it fair to make the defense discover anything to the prosecution? Why or why not?  Support your position with information.

 

  • Using Gideon and Strickland v. Washington as a foundation, do you believe the right to effective assistance of counsel in a criminal case is a meaningful one, given all of the interpretations that it has received by the U.S. Supreme Court?  What are the inherent issues?
