What legal concept is Mr James likely to use as his defense?

Mr. James is home watching television when a total stranger kicks in his back door and charges into his home waving a sword dripping with blood. Mr James (Jesse James), without standing up, draws a revolver from his chair side table and shoots the man once in the chest. The man dies and James calls the police. He is later treated for a panic-and-fear-induced heart attack. Mr James is sued by the family of the dead man who claim that he never retreated prior to firing. What legal concept is Mr James likely to use as his defense?

  1. Specific Intent
  2. Imperfect Self Defense
  3. The Castle Doctrine
  4. Accomplice Liability
