In the video she discusses the disconnect between American politics and the judicial behavior and function. Keeping her comments in mind answer these questions: Why is it important that judges generally follow the principle of stare decisis? Why is it important that they have the option of discarding precedent? Does political affiliation make it more likely that judges will be "activist" judges and generally discard precedent? If we were to take the judicial selection function out of politics, would this help solve the problem of judicial activism?
