Week 1 Assignment: Legal Standards of the Courts

At approximately 11 p.m. on a Friday night, the officer saw defendant weave within her lane from the center line to the fog line. She did not cross the center line nor leave the roadway. The officer knew that there was a banquet at a private club approximately one-half mile from where he observed defendant's car, but did not know if alcohol was served. He had heard from others that alcohol was served at the private club on occasion. He did not observe any additional traffic violations. After following defendant for three-quarters of a mile, the officer activated his blue lights and pulled defendant over.

The officer issued defendant a citation for impaired driving. Defendant filed a motion to suppress any evidence obtained as a result of her seizure and arrest, arguing that the officer lacked reasonable suspicion to stop defendant.  

Did the officer have reasonable suspicion to stop the motorist? Explain your answer.
