Call or visit your local county State Attorney Office or Court administration, and then ask for the number of total cases tried in 2013 and how many of these cases were closed through plea-bargaining. Based on your findings, develop a critical analysis about plea-bargaining by answering the following questions. Evaluate the information you obtained from the court to answer question 4.

  1. Does plea-bargaining violate due process and is it unfair because it eliminates the right for trial by jury?
  2. Do you believe that plea-bargaining reduces society's interest in appropriate punishment for crimes? Support your argument with examples from your research and this week's readings.
  3. Should the Supreme Court set rules for plea-bargaining?
  4. Based on the information received from court, do you believe the use of plea-bargaining was disproportionate? Does plea-bargaining provide equal opportunity of the law?
