Throughout the semester we have studied both the exclusionary rule and Miranda v. Arizona. These two subjects have been exhaustively debated over the decades by law enforcement, criminal practitioners and citizens. For the purpose of this discussionquestion I want you to give your opinion on both of these rules. Do you agree with either or both or do you disagree with either or both? If you had the power to re-write the constitutional rules what changes would you make? That includes no changes all,modification, or complete abolition of either or both. This question calls for an opinion so you will not be graded with regard to your opinion. You will be graded on how you present your opinion. I want facts and analysis. I want to see that you have thought aboutthis in light of what you have learned over the course of this term. Be prepared to have your position challenged by both me and the rest of the class. Keep in mind that this is not a contest to see who is right. It is to get us all thinking about our system of criminal justice.
