Civil Liberties & Human Rights

Assignment Task This assessment is in two parts – you must answer both parts; Question 1 - Problem Question

You have recently been hired by the newly elected government of the United Kingdom. This new government is extremely traditional and would like to see many modern progressive policies reversed, including the removal of the United Kingdom from the European Convention on Human Rights. The government, however, does not command enough support in the House of Commons to remove the United Kingdom from the European Convention on Human Rights. It is, nonetheless, about to draft the Morality Bill 2018 and would like your opinion on how the European Court of Human Rights might interpret the legality of the following policies:

1. Individuals sentenced to prison should be granted the option of imprisonment or physical punishment.

2. Prison officers should be required to inspect all mail received by prisoners. This includes mail received from the prisoners’ legal counsel.

3. All abortions are to be made illegal. To perform or receive an abortion will be a criminal offence.

4. The return of the death penalty.

5. All forms of speech that 'upset the morals' of the general public shall be banned.
