Tranter Builders are undertaking renovation work to the first floor at Maggie’s
Tearooms, which is due to re-open to the public in two days. Maggie’s Tearooms
is being re-opened by a local celebrity, Kitty Broadbent who stars in a long
running soap opera. It is expected that the re-opening will be packed with
members of the public keen to meet Kitty and visit the new, improved Tearooms.
Donnie Tranter of Tranter Builders is carrying out most of the renovation work.
However, as the deadline fast approaches and the pressure to complete the work
for the grand re-opening increases, he asked his friend, Ted, if he will help out.
Donnie asks Ted to replace the large window-pane on the first floor of the
Tearooms. Donnie has asked Ted to work for him on many occasions, assumes
that he is experienced in the task of replacing window panes and leaves him to
it. Ted has replaced windows before but never one as big as the first-floor
window at Maggie’s Tearooms.
The work is completed on time and the grand re-opening is about to begin. Kitty
arrives with her husband, Conrad, and is greeted by a crowd outside Maggie’s
Tearooms. As Kitty is about to announce the re-opening, the first- floor window
falls out and crashes to the ground. Kitty is directly underneath the first-floor
window when the window-pane falls out and is trapped underneath. There is
broken glass everywhere. Kitty is unconscious and covered in blood. Conrad
has sustained some minor cuts from the shards of glass.
Kitty sustains some very serious lacerations requiring plastic surgery and is
unable to return to work as an actress for 3 months.
Conrad recovers from his cuts within a few weeks but is left traumatised by the
accident and becomes very depressed.
Advise the parties on any liabilities that may arise in the tort of negligence.
