You are a paralegal employed by the prestigious law firm, Smith, Miller, & Meitzler, LLC. The firm specializes in contract law. Mary Katz, your client, has some legal questions about a recent contract. Mary owns a pet shop in downtown Miami. She routinely orders pets from Jon’s Pet Distributors & Co. A month or so ago, she ordered 5 Labrador retrievers ($1,000 each) and 3 exotic birds ($5,000 each) from Jon Sellers, the owner of Jon’s Pet Distributors. Although Jon delivered the 5 dogs within the time period agreed upon in the contract, he failed to deliver the 3 exotic birds at all. He said that when he flew down to South America in his Cesna X3 airplane to pick up the birds from his supplier, his contact there didn’t have them. So, under the cover of night, Jon turned right around and flew back to Miami. As a result of Jon’s failure to perform his obligation of delivering the birds to Mary, she lost $15,000 of business with a company that had ordered the birds from her for its annual company party. Because she didn’t receive the birds in time for the party, the company went ahead and acquired them from another pet shop. Mary wants to know whether she should file a lawsuit against Jon’s Pet Distributors for breach of contract and recover her lost profits.
