As part of a new business plan, Kinkos copied excerpts from commonly used text books, compiled them in "packets" and sold the packets to college students. Kinkos did this without permission of the respective authors or owners of the copyrights and without paying copyright fees or royalties. Kinkos has more than 200 stores nationwide and reported $15 million in assets and $3 million in profits. Three publishers who held the copyrights for the text books involved sues kinkos for violation of the copyright laws. They argue that Kinkos violated the law by copying excerpts and selling the same to college students, with their permission and without paying them. Kinkos stated that they were allowed to do so as the copying and sale constituted a "fair use" of the works in question. What result? And Why?
