Background:      The Fisher case is an interesting one. This is the second time the case is before the U.S. Supreme Court. The first time the Supreme Court sent the case back to the Fifth Circuit. The Fifth Circuit then reached the same conclusion and Fisher asked the Supreme Court to review the case again. Obviously, it agreed.
Three Part Assignment - a.k.a. What you need to do:
(1)Â In 100 words or less, summarize the facts - why did Fisher sue the University of Texas at Austin and why is the case back at the Supreme Court.
(2) In 25 words or less, what is the legal issue the court has been asked to decide. Use your own words to explain the issue. Do not simply cut and paste the issue listed on Scotus Blog.
(3) Analysis - Two options are listed below because as of the date I'm writing the syllabus, the Supreme Court has not decided the case. Choose the option that fits with what has happened at the Supreme Court when you are writing your paper.
