About
Billing professionals have access to patients’ protected health information, or PHI. Per the text, PHI is any information held by a covered entity that concerns health status, provision of health care, or payment for health care that can be linked to an individual including any part of an individual’s medical record or payment history. The HIPAA Privacy Rule regulates the disclosure of PHI and imposes stiff penalties for HIPAA violations. This discussion requires you to think about HIPAA rules as they relate to social media.
Background
After graduating , James found his dream job--working in the offices of a top sports medicine doctor. He gets to meet his idols and score free tickets to football games. He frequently posts his exploits on Facebook and Twitter and writes anonymously on a popular national blog about the sports figures that he has met. One day, his supervisor steps away from her desk without locking her computer screen. James inadvertently sees that one of the doctor’s patients, the highly paid ladies-man-of-a-quarterback on James’ favorite team, has tested HIV positive. James is conflicted.
Question
For the sake of the team and in the interest of the many women that the quarterback dates, should James leak what he knows or should he respect patient confidentiality and keep quiet? Explain what could result from each option.
