 Choose four of the following topics covered in Week Five.

Select a case on each of your chosen topics.

Write a 1- to 2-page case memorandum analyzing each case. The cases should be selected from those presented in the respective section of Law and Ethics in the Business Environment, or as researched in the Averett Library. Cases selected for analysis should be identified as those the student perceives best demonstrate significant legal principles within the specific area of the law.

Follow these instructions for each case memorandum:

  • Conclusion: Briefly present the pertinent facts surrounding the case. In your presentation of the facts, identify the parties involved and indicate which party is the plaintiff and which party is the defendant. Most of the time, the facts are stated in the section prior to the opinion. From time to time, pertinent facts are stated in the opinion. Present the facts in story form and refer to the parties as plaintiff and defendant to avoid confusion over the names. State the holding of the appellate court, such as "reversed for plaintiff" or "affirmed for plaintiff."
  • Issues: State the issue(s) that the parties are arguing about and the trial court decision. Generally, the trial court holding is stated prior to the opinion. However, following the opinion, the appellate court's holding will indicate the trial court's holding (e.g., "reversed for plaintiff" or "affirmed for plaintiff." Because most of the cases you will study are appellate court cases, state the central issue(s) on appeal. Frequently, the court will state the central issue(s) in the opinion but, if not, it is your responsibility to identify and present these issue(s).
  • Rules of Law: State what law, rule, or regulation is involved in the case, and quote from the law, rule, or regulation as necessary to enhance the understanding of the case by your audience. For example, "This is a lawsuit brought by the plaintiff against the government as defendant pursuant to 42 USC 1983."
  • Analysis: State the legal reasoning or rationale used by the court in reaching its decision, and state any rule of law derived from the case. Essentially, the court applies the law, rule, or regulation of the case to pertinent facts, using some rationale. For example, "This case establishes that partners act as agents for other partners." The most important part of your presentation for the purposes of demonstrating your knowledge of the case is the presentation of the legal reasoning or rationale used by the court and the rule of law derived from the case. This section should answer the questions raised in the issue section of your memorandum using the rules of law.
  • Opinion: Take a position and state whether you agree or disagree with the holding of the case and why you have come to your position. Further, state the overall significance of the case to law, history, business, or government, as appropriate.
  • Use the following outline to help you organize your memorandum:

      • Identify the appellate court holding
    • I-Issues 
      • Identify the issue(s) and the trial court holding
      • Identify the issue(s) on appeal
    • R-Rules of Law: Identify the law, rule, or regulation at issue

    • O-Opinion: Take a position and explain the significance
