court lacked jurisdiction

Is Kasi correct by claiming that the state court lacked jurisdiction over him in the following case?

Kasi killed three CIA employees and fled the country. He was later abducted by the FBI and returned to the U.S. to face criminal charges. Kasi claims the Virginia State Court lacked jurisdiction over him because his return to the country was not in compliance with the Pakistan-United States treaty. See Kasi v. Angelone, 300 F.3d 487 (4th Cir. 2002)
