Legal Open Memo
Write a memo to your attorney addressing the question of whether the Sub (your client) has a chance of winning against General.  Ohio law must applies. Keep your memo within three double spaced, typed pages.
Facts:
Sub recently entered into a contract with General a general contractor, to provide the plumbing for a house General was building for Owner, a well-known professional basketball player. Although Sub has experience as a plumber, this is his first job as a plumbing subcontractor. The contract between Sub and General provided that Sub would receive $20,000 for the job. Sub priced the job at cost, with no provision for profit, because Sub was desperate to get his business off the ground. The contract also included this provision: "No payments due unless and until Owner has paid General." Sub performed the plumbing work according to specifications, but has not been paid. Owner apparently is bankrupt and has paid nothing to General. Sub wants to sue General.
