Purpose:The Federal Sentencing Guidelines play a significant role in sentencing for white collar criminals. In this discussion you will consider whether the Guidelines are sufficient to deter white-collar crime.
Instructions:Based on the Booker and Gall decisions, your reading from this week, and any other material you want to rely on, discuss whether you believe the U.S. Federal Sentencing Guidelines provide a viable deterrent for business and white-collar crimes. You may address a specific category of business crimes in your discussion, such as computer crimes. Specifically discuss subjective factors that a judge might consider when sentencing in a white-collar criminal case and how these factors would vary from a blue-collar case and affect the sentence that might be imposed on a white-collar criminal.
